Outdoor Laser Show Permits in California, Explained
FDA variance, FAA notice, and the on-site Laser Safety Officer — what producers, festivals, and Bay Area planners actually need 90 days out.
Outdoor laser shows in California are regulated, federally, and not optionally. Two federal agencies are involved (FDA and FAA), one trained safety role on-site (the Laser Safety Officer), and a 60–90 day lead time for a first-time variance.
That lead time is the constraint. Most panic calls we field come 21 days before an event — past the FAA notice window and often past what the FDA can approve. This guide walks the path so producers, festival planners, and wedding teams can plan around it.
Three things you need before any beam leaves a projector
For any outdoor laser display in California using a Class 3B or Class 4 projector — essentially every visible-effect show with real throw — you need:
- An FDA variance approving the show. Filed on Form FDA-3147 with a support package. Required because 21 CFR 1040.11(c) prohibits demonstration laser products above Class IIIa unless variance-approved.
- FAA notice filed at least 30 days before any beam goes outdoors — covering setup, alignment, rehearsal, and performance. Filed under FAA Advisory Circular 70-1B using a Notice of Proposed Outdoor Laser Operation plus a Laser Configuration Worksheet per projector.
- A trained Laser Safety Officer (LSO) on site, with direct view of every beam path, authority to terminate emission instantly, and an aircraft-spotter protocol near airspace.
These are not interchangeable. An FAA letter does not satisfy the FDA. An FDA variance does not let you skip FAA notice. An LSO does not replace either filing.

The Center for Devices and Radiological Health (CDRH) is the FDA office that reviews laser variances. The application is FDA Form 3147, Application for a Variance from 21 CFR 1040.11(c) for a Laser Light Show, Display or Device. The form itself is four pages, but it is the smallest part of the package.
What CDRH actually reads is the support package: projector specs (manufacturer, model, wavelength, output per color, divergence, scan rate, interlock chain), a show description, a safety plan, and audience-distance calculations showing compliance from the closest exposed person back to the projector. For outdoor shows the package also includes the FAA notification plan.
Two timelines:
- First-time variance: 60–90 days from filing to approval. CDRH typically returns one or two rounds of clarification, each adding 2–4 weeks.
- Variance amendments: typically 30 days if you already hold an active variance. Annual reports are due September 1 each year for the previous July-to-June period.
The variance authorizes a class of operation, not a single date. Once you hold one, future shows go through amendment, not a fresh application.
The audience-scanning line: where 99% of outdoor shows live
Producers ask one question more than any other: can the beams hit the audience?
Default rule under 21 CFR 1040.10/1040.11: scanning, projection, or reflection of laser radiation into audience or other accessible uncontrolled areas is not permitted, except for diffuse reflections from atmosphere, haze, or target screens.
An audience-scanning variance is a separate, harder approval where beams may enter the audience zone at controlled exposure levels. Technically possible but rarely granted for outdoor productions, because wind, terrain, audience movement, and atmospheric drift make exposure calculations unreliable.
Practical answer: 99% of professional outdoor laser shows in 2026 scan above the audience. Beams sweep the sky, run along truss lines above heads, hit reflective targets, or terminate on a backdrop. This is what the FDA actually approves, and it is what you are seeing in festival videos online.
FAA notice: 30 days, AC 70-1B, and the airspace question
The FAA does not issue a permit for outdoor laser. They issue a letter of non-objection — or they raise objections, in which case the operation does not proceed until resolved.
The notice is filed under FAA Advisory Circular 70-1B, Outdoor Laser Operations. Two forms: Notice of Proposed Outdoor Laser Operation (one per location) and a Laser Configuration Worksheet (one per projector). California submissions route through the FAA Western Service Center, with NorCal TRACON looped in for Bay Area airspace.
What triggers notice: any beam outside the audience zone (essentially every visible aerial effect), any beam near or above the airspace ceiling at the venue, and any TFR overlapping the venue. The standard reference is the 10-nautical-mile flight hazard zone around an airport — laser projection within that radius gets scrutiny because aircraft on approach are at altitudes where even diffuse beam exposure causes flash blindness.
Minimum lead is 30 days. We file FAA notice the same day as the FDA package; earlier is fine.

Bay Area airspace: most venues are inside an airport ring
The region is dense with airports, and most outdoor venues fall inside one or more 10-nautical-mile flight hazard zones:
- SFO — Treasure Island, the Embarcadero, Fort Mason, the Presidio, much of South SF. Pier 27 and the waterfront need extra coordination because of the SFO 28L/28R approach.
- OAK — Jack London Square, the Coliseum, much of Alameda.
- SJC — downtown San Jose, Levi's Stadium, much of Santa Clara and Sunnyvale.
- Hayward (HWD), Palo Alto (PAO), Reid-Hillview (RHV), San Carlos (SQL): general aviation fields. Producing in Foster City, Redwood City, or Mountain View likely puts you inside two overlapping rings.
Where airspace pressure eases: Napa Valley north of Yountville (APC is small, objections rare), Sonoma wineries away from STS, Carmel Valley, parts of Mendocino, and the far East Bay wine country east of Livermore (LVK).
A Napa estate wedding in late September with a sky laser is a much cleaner filing than the same effect at Pier 27. Both are doable; the Pier 27 version takes longer and may come back with beam-direction restrictions limiting effects to seaward azimuths.
Class 3B vs Class 4: the regulatory line
- Class 3R (up to 5 mW): demonstration limit under 21 CFR 1040.11(c). No variance needed — and no real outdoor effect, since at 5 mW the beam is invisible in night air.
- Class 3B (5–500 mW): visible aerial beams at moderate distances. Variance required. Many small-format outdoor events run on 3B.
- Class 4 (500 mW and up — typically 5W–50W for outdoor sky lasers): the "professional" tier. Festival sky-beam imagery is 10W–50W Class 4. Variance required, and the package is longer because safety calcs are more demanding at higher power.
For a tall sky look — 50–200 meter aerial beams across an estate or festival ground — you are in 10W–30W Class 4 territory. A contained outdoor patio effect runs 3W–10W Class 4.
The actual show: LSO duties, beam-block, weather-out
Federal rules require the show be under direct, personal control of a competent operator who can immediately terminate emission. That role is the LSO.
What the LSO does on show day:
- Pre-show beam survey — walk the audience perimeter, confirm beam-block lines (truss, scrim, backdrop), verify no reflective surfaces inside the projection cone.
- Sweep checks — run each cue at low power before show; catch a misaligned scanner before audience load-in.
- Aircraft watch — a dedicated spotter watches the entire show. Any aircraft in the visual cone, beams off, restart on the next cue. This is the condition the FAA non-objection letter is built on.
- E-stop authority — independent kill-switch access. Producer says one thing, LSO sees a problem, beams off.
- Weather-out — rain, fog beyond plan, wind moving rigging beyond beam-block tolerance, the show holds. A wet stage is a different beam path than the one in the variance file.

Does FAA notice apply if my venue is far from a major airport?
Yes. Every outdoor laser operation requires FAA notice 30 days out under AC 70-1B, regardless of distance to an airport. The 10-nautical-mile flight hazard zone affects how FAA reviews the filing, not whether you must file. Far-from-airport notices come back with non-objection faster.
Can the beams sweep into the audience like in festival videos?
Default rule is no. Some festival imagery shows true audience scanning under an FDA-approved audience-scanning variance with calculated exposure limits — rare for outdoor work. 99% of professional outdoor shows scan above the audience, and that is the visual effect in those videos.
What if an aircraft enters the show area mid-show?
The spotter calls the cut, beams kill instantly, the show resumes on the next safe cue once the aircraft clears. Most outdoor Bay Area shows record at least one aircraft-driven cut; the audience generally does not notice because resumption is clean.
Do you handle laser shows outside the Bay Area?
Yes. California-wide and adjacent states. The FDA variance is national; FAA notice is filed per location. Sacramento Valley, Tahoe, Monterey, the Central Coast, and SoCal all use the same federal framework with locally specific FAA service-center routing.
